PRIVACY POLICY AND COOKIES NOTICE

This notice (the “Notice”) outlines the policies (the “Privacy Policy”) that govern the collection, use, and disclosure of data that Golf Planner Pro LLC dba PerfectGolfEvent.com (“us”, “we”, or “our”) collects from users of our websites, https://perfectgolfevent.com and https://perfectsilentauction.com (the “Service”).

By accessing and using the Service, you agree to the collection and use of information outlined in this Privacy Policy. Terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, unless otherwise defined. ARTICLE I

GEOGRAPHIC SCOPE OF THIS NOTICE

The Service is operated in the United States and is intended for users located in the United States. If you are located outside of the United States, please be aware that Personal Information (as defined below) you provide to us or that we obtain during your use of the Service will be collected in the United States and/or transferred to the United States and will be subject to U.S. law.

By using the Service and/or providing us with Personal Information, you (a) consent to the transfer and/or processing of any Personal Information to and in the United States, (b) acknowledge that U.S. law may provide a lower standard of protection for Personal Information than the laws of your location, (c) understand that we will collect, transfer, store, process and disclose your Personal Information from or about you in accordance with this Privacy Policy and U.S. law.

THE INFORMATION WE COLLECT

  1. Personal Information.While using our Service, we may obtain from you certain personally identifiable information (“Personal Information”), for example:
  1. Your first and last name, your address, e-mail address, phone number, tax identification number;
  • The dates you register with our Service, create or edit your user profile, sign up to receive newsletters, or host an event;
  • Certain demographic information, such as your age and gender;
  • Credit card and billing information you enter when you purchase one of our services products at the Perfect Golf Event Shop; and
  • The content of communications and files you send to us in messages by e-mail, through your Organizer Dashboard, or through other communication services.

In addition to the Personal Information that you provide when you use our Service, we collect the Personal Information that Event Registrants provide to us when they make payments through our Payment Service or otherwise interface with the Service (“Registrant Information”).

  • Log Data.In addition to your Personal Information, we also collect information that your browser sends to us whenever you visit our Service (“Log Data”). Log Data includes:
  1. Information about the devices used to access the Service, such as their Internet Protocol (“IP”) address, device ID and other unique device identifiers, mobile network information, information about the devices’ interactions with our Service, their hardware model, and the type and version of devices’ operating system or web browser;
  • Information about how you use our Service, such as pages viewed and the order of such pages, content or advertising you view within the Service;
  • The length of time you interact with the Service;
  • Search queries entered within the Service;
  • Error logs;
  • Websites and other services you visit before and after visiting the Service; and
  • Other similar information.

Additionally, we may use service providers or other solutions to record users’ interactions with the Service, which may include mouse clicks, mouse movements, page scrolling, and keystrokes/key touches during those sessions. Much of this information is collected through cookies, web beacons, and other tracking technologies, as described further below.

HOW YOUR INFORMATION IS COLLECTED

We collect information through A) your Account, B) third party services and C) cookies.

  1. Your Perfect Golf Event Account. When you register for an Account with our Service, we request certain Personal Information from you to be able to provide full access to the Service.
  • Third Party Services. Third party sources, such as our partners and advertisers, interactive applications, and commercially available sources such as data aggregators and public databases collect data from you as you use the Service, which we combine with the information we collect separately. We may use third party service providers and/or third-party software to record text chat to help address customer service inquiries. These third party service providers, including Google and Facebook, have their own privacy policies addressing how they use Personal and browsing Information.
  1. Google. For more information on the privacy practices of Google, please visit the Google Privacy Terms web page: http://www.google.com/intl/en/policies/privacy/. To opt out of Google’s data collection, Google recommends installing the Google Analytics Opt-out Browser Add-on – https://tools.google.com/dlpage/gaoptout. The Google Analytics Opt-out Browser Add-on provides visitors with the ability to prevent their data from being collected and used by Google Analytics.
  • Cookies. Cookies are small text files with a small amount of data that are sent to your browser from a website and transferred to your device. Cookies generally contain information that is associated with your web browser, such as website preferences, login information, or a user ID. This information enables online services to recognize you as you when you interact with or revisit the Service.

Cookies can be classified into the following four types:

  1. Strictly Necessary.Cookies that are “Strictly Necessary” are cookies that are essential to you being able to navigate the Service and use its features, such as accessing secure areas. Without these cookies, we cannot provide access to the full functionality of the Service.
  • Performance. “Performance Cookies” are used to gather statistics on how visitors use our Service. This allows us to gain insight into how users interact with the Service so that we may make improvements to the Service’s usability.
  • Functionality.These cookies are used to enhance your experience when you visit our Service such as by capturing your preferences so that they are remembered for subsequent visits to improve your experience. For this reason, our Service does not currently respond to Do Not Track signals.   • Security. Security, fraud, and legal compliance, including:
  1. Monitor, prevent, and detect fraud, such as through verifying your identity;
  • Combat spam or other malware or security risks;
  • Monitor, enforce, and improve the security of our Service;
  • Comply with any applicable procedures, laws, and regulations, subpoenas, governmental requests or legal process, or in connection with a legal investigation, if in our good faith opinion such is required or permitted by law; and
  • Establish, exercise, or defend our legal rights (e.g., to enforce compliance with our Terms & Conditions, Privacy Policy, or other contracts or legal rights).
  • Service Providers. We may provide third parties access to your Personal Information, but only to perform specific tasks on our behalf and are obligated not to disclose or use your information for any other purpose.We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, such as administering our promotions, marketing or promotional assistance, data analytics, online advertising, technology services and platforms, processing payments, customer support, including hosting chat services, or recording user interactions to assess usability of our Service, and other services.

DISCLOSURE OF INFORMATION

We may disclose information we obtain from you in the following circumstances:

  1. Business Partners. We may disclose information with third parties with whom we have business relationships, such as our co-promotional partners, advertisers, ad networks, and data marketing services, for purposes such as offering products and services that may interest you. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
  • Comply with the Law. We will disclose the information we collect where we have a good faith belief that such disclosure is: (a) required by law (or to respond to subpoenas, warrants, government requests, or similar process served on us); (b) pursuant to our DMCA notice and takedown policy and procedures; and/or (c) necessary to protect or defend our legal rights or property, our Service, you, or other third parties, or ensure the safety and security of our Service, systems, and of our customers or the general public.
  • Consent.We may disclose information about you if you ask or authorize us to do so, including by intentionally interacting with third parties on our sites. Additionally, when you choose to disclose information in a public forum, that information may be seen or collected by anyone, including third parties that do not adhere to our Privacy Policy. We are not responsible for events arising from the distribution of any information you choose to disclose publicly through our Service.
  • Aggregate Information. We may aggregate and/or de-identify information such that it is no longer linked to you or your device. This Notice does not limit our ability to disclose aggregated or de-identified information that is not linked to you. We may use and disclose such aggregated information to our partners, advertisers, and any other third parties in our discretion.

  1. Control of Personal Information. Depending on your state of residence, applicable law may allow you to make certain requests about your “Personal Information” or “Personal Data” (as such terms are defined under applicable law). Specifically, you may be permitted to request us to:
  1. Inform you about the categories of Personal Information we collect or disclose about you; the categories of sources of such information, the business or commercial purpose for collecting your Personal Information, and the categories of third parties with whom we disclose Personal Information;
  • Provide access to and/or a copy of certain Personal Information we hold about you;
  • Delete certain Personal Information we have about you;
  • Opt out of the sale or disclosure of your Personal Information;
  • Opt out of the processing of your Personal Information for targeted advertising purposes;
  • Request correction of your Personal Information; and
  • Provide you with information about the financial incentives that we offer to you, if any.
  • Communications. You may opt out of receiving any, or all, communications we send you regarding newsletters, marketing or promotional materials and other information that may be of interest to you by following the unsubscribe link or instructions provided in any email we send or by contacting us. However, we reserve the right to continue to send you transactional e-mails, such as customer service communications and shipping confirmations.

INFORMATION MANAGEMENT

  1. Security. The security of your Personal Information is important to us, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we store, to protect it from unauthorized access, destruction, use, modification, or disclosure. However, please be aware that no method of transmission over the internet, or method of electronic storage is absolutely secure and we are unable to guarantee the absolute security of the Personal Information we collect from you.

We maintain the information we collect for as long as necessary to provide the Service, for so as long as reasonably required to satisfy the purpose for which you submitted the information or our business purposes, or as required by law.

If you create an Account or register with our Service, you are responsible for maintaining the secrecy of your password at all times.

  • Links to Other Sites.Our Service may contain links to third-party websites (e.g., online stores that offer products for purchase), third party plug-ins (e.g., social-sharing buttons), and third-party features (e.g., banner advertisements). These third-party services may collect information from or about you when you interact with them, and in some cases, they may track your activity, including through the use of cookies or other tracking technologies, without you needing to interact with them. We are not responsible for the content or practices of such third parties, and their collection, use, and disclosure of your information will be subject to their privacy policies, and not this Notice. We urge you to read the privacy and security policies of these third parties.
  • Children’s Privacy. Only persons age 18 or older may have access to our Service. Our Service is not directed at anyone under the age of 13 (“Children”), nor do we knowingly collect Personal Information from Children. If you are a parent or guardian and you learn that a child has provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from Children without verification of parental consent, we will delete such information in a reasonable period of time if we become aware of it. If you have any questions about our practices with respect to children’s privacy or wish to request that we delete Personal Information provided by your child, please contact us.
  • Business Transactions. If we are involved in a merger, acquisition or asset sale, your Personal Information may be transferred as a business asset. In such cases, we will provide notice before your Personal Information is transferred and/or becomes subject to a different Privacy Policy.

ARTICLE VIII

NOTICE FOR CALIFORNIA RESIDENTS

This Notice gives California residents additional information about our information collection and use practices required by the California Consumer Privacy Act of 2018 (“CCPA”), and also provides California residents with specific privacy rights.

  1.  California Information & Deletion Rights. Please see the “Your Privacy Rights” section of our Privacy Policy for information about the rights you have under California law and how to exercise them.
  •  Notice of Right to Opt-Out of Sale and Sharing of Personal Information. California residents may opt out of the “Sale” of their Personal Information. Under the CCPA, “sale” is broadly defined to mean the disclosure of Personal Information with third parties who are not acting as our service providers or who are otherwise not restricted from using data only on our behalf or pursuant to an applicable CCPA exception.

In some circumstances, we may disclose certain of your information to third parties to provide you with offers, promotions, and opportunities that may be of interest to you, which may be considered a “sale” under the CCPA. Under the CCPA, “sale” may also include allowing third parties to “collect” certain information, such as IP address, and/or browsing behavior, through cookies and similar technologies, to deliver targeted advertising on the Services or other services. Advertising, including targeted advertising, enables us to provide you certain content for free and allows us to provide you offers relevant to you.

The CCPA also allows California residents to opt out of the “sharing” of their Personal Information for “cross-context behavioral advertising.” Under the CCPA, this activity is defined as the targeting of advertising to a consumer based on that consumer’s Personal Information obtained from the consumer’s activity across websites. We “share” information for these purposes to provide more relevant and tailored advertising to you regarding our Service and the services of our partners.

If you would like to opt out of our use of your information for such purposes that are considered a “sale” or “sharing” under California law, you may do so by contacting us. Please note that we do not knowingly sell the Personal Information of minors under 13 years of age without legally-required affirmative authorization.

Please note that we respond to and abide by browser-based opt-out preference signals. Any opt out preferences you have exercised through these methods will only to the browser on which you made them. The CCPA further provides you with the right to not be discriminated against (as provided for in applicable law) for exercising your access, deletion or sale/sharing opt out rights.

The CCPA also allows you to limit the use or disclosure of your “Sensitive Personal Information” (as defined in the CCPA) if your Sensitive Personal Information is used for certain purposes. Please note that we do not use or disclose Sensitive Personal Information other than for purposes for which you cannot opt out under the CCPA.

  •  Retention of Your Personal Information. We will only retain your Information for as long as is necessary for the purposes described in this Privacy Policy. This means that the retention periods will vary according to the type of Information and the reason that we have collected the Information in the first place. In determining how long to retain information, we consider the amount, nature and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which we process the information, applicable legal requirements, and our legitimate interests. The purposes for which we process information (as well as the other factors listed above) may dictate different retention periods for the same types of information. For example, if you purchase a product from our Perfect Golf Event Shop, we will retain your payment history records for a period of time after your your purchase for our anti-fraud and legal compliance purposes. If you opt out of email marketing, we maintain your email on our suppression list indefinitely to comply with your request. We may delete or de-identify your information sooner if we receive a verifiable deletion request, subject to exemptions under applicable law. We may retain cached or archived copies of your information.
  •  California “Shine the Light” Disclosure. If a company shares “Personal Information” (as defined in California’s “Shine the Light” law, Civil Code § 1798.83) with third parties for their direct marketing purposes (e.g., to send offers and information that may be of interest to you), California law requires either providing a mechanism by which consumers can obtain more information about such sharing over the prior calendar year, or providing a mechanism by which consumers can opt out of such sharing. As discussed above, we provide an opt out for this sharing. If you are a California resident and would like to opt out of sharing pursuant to this law, please contact us.

NOTICE FOR NEVADA RESIDENTS

Under Nevada law, Nevada residents who have purchased goods or services from us may opt out of the “sale” of “covered information” (as such terms are defined under Nevada law) for monetary consideration to a person for that person to license or sell such information to additional persons. In some circumstances, we may disclose your information to certain third parties that we believe can provide you with offers and promotions for products and services of interest to you. This disclosure may qualify as a sale under Nevada law. If you are a Nevada resident who has purchased goods or services from us, you may submit a request to opt out of “sales” activity by contacting us. Please note we may take reasonable steps to verify your identity and the authenticity of the request.

MISCELLANEOUS

  1. Changes to Privacy Policy.This Privacy Policy is effective as of January 1, 2024 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.


            We reserve the right to update or change our Privacy Policy at any time. Your continued use of the Service after any modifications to the Privacy Policy will constitute your acknowledgment of the modifications and your consent to abide by and be bound by the modified Privacy Policy.

If we make any material changes to this Privacy Policy, we will notify you either through the email address you have provided us, or by placing a prominent notice on our website.

  • Governing Law. This Privacy Policy and all disputes arising hereunder or relating hereto shall be governed by, and will be construed under, the laws of the State of Florida, without regard to its choice of law principles. Those who choose to access the Service from locations outside the United States do so on their own initiative and are responsible for compliance with local laws if and to the extent local laws are applicable. By using the Service, you agree that the exclusive jurisdiction for any dispute shall be the state and federal courts located in Duval County, Florida.
